One Man Injured in Six Car Accident in Bloomfield

One man was taken to the hospital after personnel from the Greene County Sheriff’s Department and Ambulance Service, the Indiana State Police and at least three fire departments responded to the scene of an accident involving six vehicles south of Bloomfield late Monday afternoon. Stephen C. Floyd, 57, Bloomfield, was transported by ambulance to Greene County General Hospital with head and neck pain. No additional information was released on his injuries. Greene County Sheriff’s Deputy D. Leon Dunigan and Det. George Dallaire both responded to the scene along with Indiana State Police Trooper Eric Russell and the Owensburg Fire Department, Taylor Fire Department and Crane Fire Department.

Dunigan said the accident occurred at approximately 4:24 p.m. at the intersection of U.S. 231 and State Road 58, also known as Hasler’s Junction or Time Oil. The accident report states Donald L. Black, 77, of Piqui, Ohio, was eastbound on U.S. 231 in a 1995 black Dodge truck. He tried to stop at the junction with SR 58 but was unable and the truck began sliding on wet pavement. Dunigan reported Black’s truck struck another vehicle, a silver 2005 Toyota driven by Floyd, in the rear causing it to then strike another vehicle in the rear as it was turning north. The third vehicle was a white 2007 Chevrolet driven by William D.Hidey, 44, Bloomfield. According to Dunigan’s report, Black’s truck then swerved to the south and struck three more vehicles that were parked at Hasler’s Junction.

Bus Driver and Student Seriously Injured in School Bus/Gravel Truck Collision in Pikeville

Kentucky State Police say a school bus driver and a student from eastern Kentucky have been seriously injured in a collision with a gravel truck in Pikeville. Police say emergency workers had to extricate the driver and student from the bus after the crash on U.S. 460 around as rain fell around 3:30 p.m. EDT Monday. Trooper Mike Goble told the Lexington Herald-Leader he estimated about 12 to 15 of the 45 students on board the bus were taken by ambulance to Pikeville Medical Center. Some of the other students were being taken by their parents to be examined. A hospital supervisor didn’t have conditions available Monday night. Police said the gravel truck driver, Kendall Slusher of Salyersville, wasn’t injured. Police say he was traveling west and hit the bus after losing control of the truck and sliding into the eastbound lane.

Two People Injured on US 20 in Steuben County Indiana

Two people were transported to Cameron Hospital by Steuben County EMS and one patient with multiple injuries was flown by Lutheran Air to a Fort Wayne hospital in a near head-on collision involving a mid-size car and an SUV. Orland and Salem Fire Rescue crews along with Steuben County EMS and units from the Steuben County Sheriff’s Department responded to an accident on U.S. 20 at the West Otter Lake curve at 3:30 p.m. Saturday afternoon. Sarah Williams, 24, of Orland, was tightly pinned in her vehicle when rescue units arrived. Rescue tools were used to free Williams in just over 30 minutes. Her condition is unknown at this time.

Two Injured on Indiana Toll Road After Semi Tractor Trailer Rolls Over

A semi-tractor trailer rollover into the median of the Indiana toll road sent two people to the hospital this morning. The accident happened just after 7 a.m. between mile markers 59 and 60, near the St. Joseph and Laporte County line. Indiana State Police say one of the passengers that was transported to the hospital was complaining of back pain. There is no word on the cause of the accident as police were investigating.

Preparing to win your case at trial and on appeal

A recent decision by the Kentucky Court of Appeals reminds me of the need that a claim is not over until it is over.  In fact, this case involved an appeal of an erroneous trial court ruling that I successfully prosecuted to the Kentucky Court of Appeals.

There are so many steps that the lawyer must anticipate to insure that an injured claimant is fully compensated.  When you are injured it is very important to contact a good personal injury lawyer to begin preparation of your claim.  These steps include not only identifying insurance to compensate the victim and the evidence you will need to prove the injuries and damages, but anticipating how the insurance company is going to try and refuse to pay or deny the claim.

Every personal injury attorney must prepare the claim and accumulate and identify the needed experts, witnesses, medicals, wages, permanent injuries, etc. to simply document the claim.  And should the insurance company continue denying the claim, then be ready to file suit and try the case.  However, trying the case is not the end of the road as attorneys for the insurance company defending the claim will attempt to raise issues in case they should lose at trial to get the case reversed on appeal.

I refer to this as being ready to try your case again on appeal should the trial judge get it wrong or make a wrong or incorrect legal decision.   Trial judges can make mistakes and make more incorrect legal decisions than you would think.  For example, in a recent period, the Court of Appeals found serious enough errors to reverse, remand or dismiss an appeal because of mistaken rulings by the trial judges in 12 of 37 appeals.  That is nearly 1 out 3 trials have mistakes made by the judge which favor one side or the other.

Therefore it is important to hire a lawyer prepared to prepare your case to settle, to be tried, and to be appealed, if necessary, to see that justice is done.

The appellate decision that again reminded me of this need to prepare and preserve the record and to fight until you get the right result was Lynch v. Claims Management Corporation.

In Lynch v. Claims Management Corporation, Charles Lynch suffered serious and permanent injuries to his knee when struck by an uninsured motorist.  Fortunately, Mr. Lynch had uninsured motorist benefits to cover him, and he recovered $160,000 from his insurance company.   He was also fortunate to have personal health insurance to pay his medical bills and disability insurance to cover his lost wages while he was unable to work since his $10,000 in personal injury protection benefits would not cover his entire loss.  However, his disability and health insurer wanted  to be paid first and off the top for the nearly $68,000 it had paid.  And they wanted to be paid out of Mr. Lynch’s own recovery under his own separate policy for uninsured motorist benefits.   The trial judge ruled against Mr. Lynch at trial which required Mr. Lynch to hand over nearly $68,000 of his $160,000 recovery to the insurance company that paid his medical bills and disability (and to whom he had already paid policy premiums for the coverage!).

I thought the policy language was wrong, the insurance company was wrong, and the trial judge was wrong; and the Court of Appeals in Lynch v. Claims Management Corporation agreed with me reversing the trial judge and returning the $68,000 to the client.

Still the fight continues as the insurance company does not want to pay the statutory interest to the client during the pendency of the appeal and when he was deprived of the use of his money.  Thus, another legal fight to protect the client’s money.

Motorcyclist in Critical Condition After Car Accident in Lexington

Lexington Police are reporting that  Chester Salisbury is in critical condition after the motorcycle he was riding was struck by a vehicle driven by Rafael Zuniga. Zuniga was traveling west on Fourth when he made a sudden left turn onto Broadway, crossing in front of Salisbury’s path going eastbound.  Both drivers and a passenger in Zuniga’s vehicle were taken to University of Kentucky hospital.

Two Injured in a Three Vehicle Collision on KY-54

According to a report by the Kentucky State Police report that a 1994 Dodge Ram pickup, operated by a James Downs of New Haven, Kentucky was westbound on KY54 near Green Valley, Kentucky when a 1990 Honda, operated by a David Parker Jr, of Leitchfield, Kentucky was eastbound on KY54. Mr. Downs vehicle, for unknown reasons, made an abrupt left turn into the path of Mr. Parker’s vehicle. Mr. Parker attempted to avoid hitting Mr. Downs, but was not successful. A 2005 Nissan, operated by Tami Salmon of Falls of Rough, Kentucky was eastbound behind Mr. Parker’s vehicle and attempted to avoid the first collision but struck Mr. Parker’s vehicle in the rear end. Mr. Parker and a passenger in Mr. Downs vehicle were transported to Twin Lakes Regional Medical center and Mr. Parker was later flown to University of Louisville by Air Methods. No charges expected to be filed. The investigation is ongoing by Trooper D. Norris with the Kentucky State Police. Grayson County Sheriff’s office, Leitchfield Fire Department, and Grayson County EMS responded to the scene as well.

Morehead Man Killed While Working for Demolition Disposal Services

A Morehead man was killed on the job Wednesday afternoon while working for a Lexington landfill company. Jesse Hodges was loading bins for delivery to a landfill when he was pinned between two dumpsters at the worksite located at 4179 Hedger Lane.  The owner of the landfill, Demolition Disposal Services is investigating the incident at this time.

Hodges was pronounced dead by the University of Kentucky Medical Center at 2:40 p.m. due to multiple blunt force trauma. Hodges is survived by his wife Shayne and stepchildren Kyler and Shelby Gilbert. He was the son of Steve and Cindy Hodges of Morehead.

Man Killed in Car Accident on Harrodsburg Road and Dogwood Trace

Brian Houck was killed at 9:22 p.m. Thursday in a car accident on Harrodsburg Road and Dogwood Trace, according to the Fayette County coroner’s office.  The cause of death is reported as multiple blunt-force injuries and he was pronounces dead at University of Kentucky Hospital. Houck was killed when two vehicles collided at 6:45 p.m. at Harrodsburg Road and Dogwood Trace. Police said the other driver, Joe Moore, 80, of Lexington, turned left in front of Houck’s car when both had a green light. The vehicles collided and came to rest on the grass at the entrance of the Dogwood Trace subdivision.  The police are still undergoing investigation of the crash at this time.

Four People Hospitalized After Car and Ambulance Collide at Taylorsville Road and Furman Boulevard

A rural Metro Ambulance and car collided at the intersection of Taylorsville Road and Furman Boulevard at 11:00 pm on Wednesday night. The ambulance, transporting a patient, was on its way to the hospital with its emergency lights and sirens on when the driver of the other vehicle, a Toyota Camry, drove through a red light and collided with the ambulance.  All individuals were taken to the hospital though not of the injuries were life-threatening.

Motorcycle and Car Collide in Glasgow

The Glasgow Police Department has reported a car accident involving a automobile and motorcycle last night on Veterans OUter Loop at about 7:30 p.m.  The driver, Ricky D. Ervin of Summer Shade was killed when the motorcycle collided with a vehicle. A female passenger who was riding on the motorcycle was stat flighted to University of Louisville Hospital with critical injuries.  Two individuals in the vehicle were transported to T.J. Samson Community Hospital and treated for minor injuries.  The Glasgow Police Department is investigating the collision with the Barren County Sheriff’s Office.

One Taken to Hospital After Three Car Accident in Somerset

A three-vehicle accident at a U.S. 27 intersection sent one person to the hospital Wednesday afternoon and snarled traffic as officials worked to clear the scene. According to an accident report filed by the Somerset Police Department, the collision occurred at light 8, in front of Kentucky Fried Chicken and Culver’s, at around 12:20 p.m. Wednesday. According to the report, the accident occurred when Janice E. Barron, 64, of Ron-Dale Drive, Somerset, was traveling southbound on U.S. 27 in a 2006 Ford Freestyle when her vehicle collided with a 2003Honda CRV operated by Christina O’ Bryan, 55, of Rocky Hill Road, Bronston.

O’ Bryan was attem-pting to cross U.S. 27 from Tradepark Drive at the time of the impact, in which Barron’s vehicle collided with the left side of O’ Bryan’s vehicle with her front bumper.A third vehicle was also involved in the collision. According to the report, Sarah Dalton, 76, of White Way Inn Road, Monticello, operating a 2001 Dodge Caravan, was attempting to travel westbound from Sonny’s Way at the intersection when her vehicle collided with Barron’s Freestyle in the left side. All three vehicles came to rest in the middle of the intersection, and traffic in the southbound lanes of U.S. 27 was limited to one lane while crews worked to clean up the accident scene.

O’ Bryan was trans-ported to Lake Cum-berland Regional Hospital after she reportedly complained of neck and hand pain. LCRH spokesperson Susan Wilson said O’ Bryan was treated in the emergency room but not admitted. ”The driver of unit 1 (Barron) stated that she believed she had the green light while traveling southbound on U.S. 27 in the far left lane,” stated the report. “She then stated that the other units (O’ Bryan and Dalton) pulled in front of her vehicle.” According to the report, both O’ Bryan and Dalton were attempting to cross U.S. 27 when the collision occurred, and Dalton reportedly told officers “she was sure she had a green light.” O’ Bryan reportedly stated to officers that she had slowed down and was waiting for a car on the opposite side of the intersection to clear when the collision occurred.

“One witness stated that the southbound lanes of U.S. 27 had a red light at the time of the collision,” the report stated. That witness had seen the entire collision, but was unsure as to which way the vehicles were traveling when the incident occurred. Barron and Dalton and a passenger in Dalton’s vehicle, Elizabeth Duncan, were not injured in the accident. Everyone was wearing a seat belt at the time of the collision.

Fatal accident on Bardstown Road in Louisville

A woman was killed after the vehicle she was driving lost control and slammed into a tree at the intersection of Bardstown Road and Beuchel Bypass.  The woman, 19-year old Lavada Coleman, was pronounced dead at the scene as a result of her injuries.  Police are currently investigating the accident.

Motorcyclist Killed on State Road 62 at Monroe Street

A man was killed in a motorcycle accident in Charlestown, Indiana on State Road 62. Police are reporting that two motorcycles were speeding when one of them crashed into a car at Monroe Street. The motorcyclist killed has been identified as Bryan Tucker, 21, of Charlestown. The person in the car had minor injuries.

New Haven Man Causes Three Car Accident

A New Haven man’s truck turning into oncoming traffic caused a three-car collision on Tuesday morning.  Kentucky State Police Trooper Bruce Reeves explained that James Downs of New Haven was traveling westbound in his 1994 Dodge Ram pickup on Hwy54. For some reason Downs turned into the lane of a 1990 Honda, driven by David Parker Jr. of Leitchfield. Parker was headed eastbound on HWY 54. Parker tried to avoid hitting Downs, but was not able to.  Tami Salmon of Falls of Rough, who was driving a 2005 Nissan behind Parker, tried to avoid being involved in the collision. She ended up crashing into the rear-ending Parker’s vehicle. Air Methods transported Parker to University of Louisville hospital, after being initially taken to Twin Lakes Regional Medical Center. A passenger in Down’s truck was also taken to Twin Lakes Regional Medical Center for injuries.

Elizabethtown Boy Struck by Truck on U.S. 31 in Glendale

A 14-year-old Elizabethtown boy was sent to University Hospital in Louisville after he was hit by a pick up truck Friday night on U.S. 31 near Kentucky Route 222 in Glendale. Police report a pickup truck driven by Adrian Maddox of Bonnieville, Kentucky hit the boy as he ran across the street. The teen was flown to University Hospital with life-threatening injuries though Maddox was not hurt.

Five People Injured in Accident Between Car and Ambulance on Taylorsville and Furman

Police reported five people were injured last night after a car accident involving an ambulance.  At approximately 11:00 pm Wednesday night an ambulance taking an elderly man to the hospital was struck by a car at the intersection of Taylorsville Road and Furman Road.  Reports indicate the ambulance did have its emergency lights on at the time of the collision.  Two individuals in the car, both EMS workers and the elderly patient were transported to local area hospitals.

Two Car Collision Near Lebanon Junction

The Courier-Journal is reporting a mid-afternoon head-on collision happened roughly half of a mile north of Ky. 733. The accident potentially injured three people with air medical transport being called in, according to the Bullitt County Sheriff’s Department.

Driver Flees Crash that Killed Construction Worker in Indiana

A person fled on foot after that person’s car struck and killed a construction worker on Interstate 80 in northwest Indiana early Tuesday morning reports the Chicago Sun-Times. The construction worker was employed by Walsh Construction out of Gary, Ind. and was cold patching pot holes in the far two left lanes just west of Ripley St. at about 1:28 a.m. Tuesday.  Indiana State Police are reporting that a 1993 Mercury Cougar struck the construction worker, throwing him into the windshield of the vehicle.  The worker partially landed on the driver of the vehicle who immediately got out of the car and ran south from the scene after a fellow construction worker stood in front of the vehicle to prevent the driver from speeding away.  As of 6:15 am. the driver of the vehicle was not located but the Indiana State Police are reporting that the construction workers at the scene were able to provide a description.

Our sincere condolences go to the family of this construction worker. All too often drivers of vehicle fail to slow down in construction sites, failing to realize the danger involved in driving so fast within arm’s reach of workers.

Accident Closes Southbound I-75 in Whitley County at Kentucky-Tennessee Border

Kentucky State Police have reported an accident involving a semi tractor-trailer and a van that has southbound I-75 closed near the Kentucky-Tennessee border.  Kentucky State Police say the semi flipped the van and then lost control, slamming into a concrete wall near the three mile marker around 4:15 a.m. The impact caused the truck spill diesel fuel and burst into flames on an overpass.

Pickup Truck in Elizabethtown Strikes Teenage Pedestrian

A 1989 Toyota pick up, operated by Adrian Maddox of Bonnieville, Kentucky was traveling south bound on US31W near KY222 in Glendale, Kentucky. A pedestrian 14 year old male of Elizabethtown, Kentucky was across US31W ran into the patch of the vehicle and was struck. The pedestrian was flown from the scene to the University of Louisville Hospital with life threatening injuries. The driver of the pick up was not injured. No charges are expected to be filed. The investigation is on going by Trooper B. Riley with the Kentucky State Police. Hardin County EMS, AirMethods, and Glendale Fire Department responded to the scene also.

KSP Investigating Fatal Two Car Collision in Henderson, KY

According to Kentucky State Police Post 7 Richmond, they are investigating a fatal two-car collision which occurred at 7:58 a.m., in the Lincoln County community of Hustonville. The collision occurred at the intersection of US 127 and KY 2141 at Hustonville. Gordon Kaiser, age 38 of Hustonville was traveling North on US 127. Kaiser was operating a 2002 Toyota Sequoia. Amy Vonlinger, age 31 of Hustonville was traveling on KY 2141 in a 1997 Dodge Intrepid. Ms. Vonlinger apparently merged onto US 127 directly into the path of Mr. Kaiser. The Kaiser vehicle struck the passenger doors of the Vonlinger car, and pushed it into a guardrail. West Lincoln County EMS responded to the scene and transported Ms. Vonlinger, and her five-year old daughter, Ryllie, to Ephraim McDowell Regional Medical Center in Danville. Ryllie Vonlinger was pronounced dead at Ephraim McDowell RMC by the Boyle County Coroner’s Office. Kaiser was not injured. A KSP Collision Reconstructionist has responded to the scene and will assist with the investigation. The collision remains under investigation by Trooper Rodney Wren and Sergeant Starlin Hacker. Next-of-kin have been notified.

Even though the KSP’s accident reconstructionist is investigating the collision, it is important that anyone involved retain their own attorney so that the lawyer can have their own accident reconstructionist work on the scene early. Teacher Killed by DUI Driver in Corbin, Kentucky

A fourth-grade teacher, Elizabeth Denman, of Big Creek, was killed by an allegedly drunk driver Thursday night when Ronnie G. Hacker’s pickup truck crossed the center lane on Kentucky 11 in Clay County and struck Denman’s sedan head-on. Both Denman and Hacker were pronounced dead at the scene. Hacker’s passenger, 30-year-old Bill R. Henson of Manchester, was airlifted to University of Kentucky Hospital for his injuries. Kentucky State Police believe Hacker was under the influence of alcohol at the time of the collision.

Bush Elementary Principal Lisa Sibert said Denman was in her seventh year of teaching at the school. Beth Denman grew up in Big Creek in Clay County. Her parents Tom and Chris Denman moved to Big Creek from Ohio when Beth was about 18 months old to run the Joy Center, a community outreach program, in the former Big Creek Elementary school building.

Denman had two children, a first grader who attends Bush Elementary and a 13-year-old in middle school. Denman’s father said staff at Bush have offered to take turns picking up her son so he can continue school at Bush Elementary.

Pedestrian Struck in Downtown Lexington

A pedestrian was hospitalized in Lexington Monday morning after being hit by a car at Main Street and Broadway. Police were called at 6:48 a.m., when the man was hit by a navy blue Honda Civic. The pedestrian was taken to University of Kentucky hospital for his injuries however his name has not been released.
